Release of Liability, Waiver of Claims, Express Assumption of Risk, Indemnity Agreement and Photo & Video Release

Please read carefully and be certain you understand the implications of signing

1. I fully understand and appreciate that axes of any size are potentially dangerous objects, the dangers, hazards, and risks inherent in axe throwing and the inherent risks associated with the use and misuse of axes by myself and others.

2. I acknowledge and understand that I will be voluntarily engaging in activities that involve axes which may result in, but not necessarily be limited to, the risk of serious injury, scarring, loss of an important bodily function, permanent disability or death and may cause severe social or economic losses due to not only my actions, inaction or negligence, but also the action, inaction or negligence of others or conditions of the premises or of any equipment used. Further, I acknowledge that there may be other risks not known to me or not foreseeable at this time.

3. I assume all the risk and accept responsibility for the damages following such injury, permanent or temporary disability, or death regardless of the cause or responsible party.

4. I believe that I am physically, emotionally and mentally able to participate in axe throwing and by signing below provide confirmation of my ability to participate.

5. I will immediately remove myself from participation, and notify the nearest staff member if at any time I sense or observe any unusual hazard or unsafe condition, or I feel that I have experienced any deterioration in my physical, emotional or mental fitness for continued participation in any activities on the premise.

6. I release from liability and waive and discharge all actions, claims and/or demands that I, my assignees, heirs, guardians, and legal representatives now have or hereafter may ever have for damage or losses on account of injury, including permanent disability and death or damage to property, caused or alleged to be caused in whole or in part by the negligence or other acts of Chopper’s Hatchet House, LLC, its subsidiaries, shareholders, members, directors, officers, employees, agents and/or landlords, WATL and IATF as a result of my participation in any axe throwing related activities and/or my presence at the facility operated by Chopper’s Hatchet House.

7. I agree that I, my assignees, heirs, guardians, and legal representatives shall not to sue or bring any similar action against Chopper’s Hatchet House, LLC, its subsidiaries, shareholders, directors, officers, employees, agents or landlords as a result of my participation in any axe throwing related activities and/or my presence at the facility operated by Chopper’s Hatchet House.

8. I understand the consuming alcohol is not a requirement to participate in any event. If I do consume alcohol during an event, I confirm that I am 21 years of age and I am doing so of my own choice and volition and agree to consume alcohol responsibly.

9. I assume the risks associated with alcohol consumption and take full responsibility for my own actions, safety and welfare of myself and others affected by my consumption of alcohol.

10. I agree to exercise ordinary and reasonable care at all times, and will not consume alcohol to the extent that my judgement is impaired. I understand the potential risks associated with the consumption of alcohol and acknowledge that I do not have or am not aware of any medical condition(s) that would prevent me from consuming alcohol or would result in any injury or liability for any accident, injury, theft, loss or damage caused by my impaired judgement or negligence.

11. I agree and understand that the staff and owners and members of Chopper’s Hatchet House, LLC reserve the right to refuse entry, suspend or cancel any activity, axe related or otherwise, at any time for any reason.

12. I hereby grant permission to the rights of my image, likeness and sound of my voice as recorded on audio or video tape or other recording medium without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and I waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or voice recording.

13. I understand that all activities on premises are being recorded for visual and audio record of activities for the safety and welfare of all participants.

14. For league play, I agree and understand that this waiver, release and assumption of risk will remain on file and apply to the current league season and any future league seasons in which I participate.

15. I understand that any knowledge of axe throwing as a business learned while participating at Choppers Hatchet House is not to be used to start an axe throwing venue.

16. I agree to receive future email correspondence including news and coupons. This can be unsubscribed from any time within the emails sent.

17. I hereby release and indemnify Choppers Hatchet House, LLC, its owners, agents, servants and employees, from any liability regarding any claims relating to SARS-CoV-2, COVID-19, and any other viruses or illnesses that I may contract as a result of my entering into Choppers Hatchet House, LLC place of business, taking part in any activity there or coming into contract with any person there. In consideration of the right for me to enter Choppers Hatchet House, LLC’s place of business and participate in activities there, and for other good, valuable and legal consideration, the receipt and sufficiency of which are acknowledged, I state and agree as follows:

I am aware that SARS-CoV-2, COVID-19, and other viruses and illnesses are contagious. I am aware that people with SARS-CoV-2, COVID-19, and other viruses and illnesses can be non-systematic, meaning that people may be sick and contagious without symptoms. I am aware that if I enter Choppers Hatchet House, LLC’s place of business, I am doing it at my own risk and could be exposing myself to SARS-CoV-2, COVID-19, and other viruses and illnesses. I am aware that I may be required to leave Choppers Hatchet House, LLC’s place of business if I display signs of illness and may not receive any refund of payments I have made.

I will indemnify Choppers Hatchet House, LLC, its owners, agents, servants and employees, from any claims no matter the source, allegedly exposure to or contraction of SARS-CoV-2, COVID-19, and other viruses and illnesses due to my presence at Choppers Hatchet House, LLC’s place of business. I will pay any legal fees, damages, settlements, and costs related to such claims brought by any individual or entity including myself and my family members. I agree that I will wear a mask at all times as long as this mandate is in place by the Governor, governmental authorities and/or other health authorities, or if otherwise directed by Choppers Hatchet House, LLC’s employees, and I will keep at least six feet away from individuals who did not come to Choppers Hatchet House, LLC’s place of business with me as well as from Choppers Hatchet House, LLC employees and third parties as long as the State of New Jersey, the Center for Disease Control or any other governmental agency require or suggest such conduct or if otherwise directed by Choppers Hatchet House, LLC’s employees. I am aware that if I violate this and do not wear a mask or maintain the six feet distance from others I will be required to leave immediately with no refund given.

Assumption of the Risk: I acknowledge the activities I am undertaking at Choppers Hatchet House, LLC’s place of business could expose me to SARS-CoV-2, COVID-19, and other viruses and illnesses and that injuries, death, property damage, or other harm could occur to me or others. I am voluntarily participating in the activities Choppers Hatchet House, LLC’s place of business with knowledge or the risks, hazards, and other dangers involved. I hereby accepts any and all risks of injury (including death) to me arising out of or in any way connected with my activity at Choppers Hatchet House, LLC’s place of business.

Release. I hereby waive, release, and forever discharge any and all claims for damages for personal injury, death, or property damage which I and/or my children, heirs, executors, assigns, parents, personal representatives, or estate may have or which may hereafter accrue as a result of my presence at Choppers Hatchet House, LLC’s place of business.

Indemnification. I, to the fullest extent permitted by law, shall indemnify, hold harmless, protect and defend Choppers Hatchet House, LLC, its owners, agents, servants and employees, from and against any and all liabilities, claims, damages, losses, demands, lawsuits, costs, and expenses, including, but not limited to, attorney fees, arising out of or resulting from my negligence or misconduct in connection with my participating in the activities at Choppers Hatchet House, LLC’s place of business or which relate to my exposure to my exposure to SARS-CoV-2, COVID-19, and other viruses and illnesses while present there even if it does not result from my negligence. Should any such claim, demand, or lawsuit arise or be asserted in any way whatsoever related thereto, whether arising under the laws of the United States, any state, or under any theory of law or equity, I will indemnify, hold harmless and defend Releasee from any and all costs, expenses, or liability including but not limited to the cost of any settlement or judgment made or rendered against Choppers Hatchet House, LLC, its owners, agents, servants and employees.

Financial Responsibility. In the event that I should require medical care or treatment for illness or injury sustained as a result of my presence at Choppers Hatchet House, LLC’s place of business, I agrees to be financially responsible for any costs incurred as a result of such treatment. I represent that adequate health insurance is in effect to cover any injury or illness suffered or damage caused while participating in activities at Choppers Hatchet House, LLC’s place of business.

By entering this agreement, I am not relying on any oral or written representation or statements made by the releases, other than what is set forth in this agreement

I HAVE CAREFULLY READ THE ABOVE WAIVER AND RELEASE OF LIABILITY AND FULLY UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING THIS WAIVER AND RELEASE OF LIABILITY AND I DO SO VOLUNTARILY. I UNDERSTAND THAT PRIOR TO SIGNING THIS DOCUMENT I MAY HAVE IT REVIEWED BY AN ATTORNEY OR OTHER PROFESSIONAL. I AGREE TO PARTICIPATE KNOWING THE RISKS AND CONDITIONS INVOLVED AND DO SO ENTIRELY OF MY OWN FREE WILL AND I FULLY ASSUME ALL RESPONSIBILITY.
